The insurance company can later recover the amount from the owner of the vehicle.


Kurt gave this decision on the plea of ​​Parminder Singh, who was disabled in an accident in Punjab in 2009. Capt Kanwaljeet Singh, the then Cabinet Minister of Punjab, was killed in this accident. Parminder was driving his car. Justice Indu Malhotra and MR Shah's bench increased the compensation of Paraminder from Rs 21 lakh to Rs 50 lakh. Justice Malhotra said that drivers of both trucks that hit Paramidar's car did not have a valid driving license. On this basis the insurance company has refused to pay the compensation.


In such cases the principle of 'fill and recovery' applies. Accordingly, the insurance company is obliged to pay compensation to the victim. However, the amount of compensation given to the victim can be collected later by the vehicle owners.


Truck collapsed from wrong direction: Car collision: On March 29, 2009, Punjab's Minister Captain Kanwaljit Singh was going with driver Parminder Singh. While crossing the wrongly raised truck on the road, another truck, which was in the wrong direction, hit the car. The minister was killed in the accident, while Parminder was seriously injured. He had a case against the truck driver, his owner and the insurance company for compensation.

The Motor Vehicle Accident Compensation Tribunal, located in Panchkula, ordered the insurance company to pay a compensation of 10 lakh 43 thousand 666 rupees. The High Court raised the compensation on September 20, 2017 to 21 lakh 6 thousand rupees. Parminder reached the Supreme Court after refusing to pay compensation to the insurance company.
